Arbitration and mediation are the most rapidly developing methods of dispute resolution, which is proven by, for instance, the recent changes in the legal system. Entrepreneurs are more and more likely to use these alternative means in order to avoid lengthy and expensive lawsuits. Moreover, it is undoubtedly more beneficial to turn a dispute into the cornerstone of a fruitful and long-term cooperation, rather than ruining a prospective business relationship. For the methods to be used, business partners must include an arbitration, mediation or a mixed clause in their contracts, which is not as complicated as it seems.
We encourage every experienced or beginning entrepreneur, lawyer and person interested in practical business solutions to take part in the „Settle a dispute with a contractor in an effective and modern manner” panel. During the session, experts will explain, among other things, what are the benefits of using arbitration and mediation and in what situations they might be used. The participants will also learn about the most efficient way to construct the clauses and what are the mistakes that should be avoided. Furthermore, we will discuss whether common courts are open to alternative dispute resolutions.
The discussion will feature the participation of both Polish and foreign experts who, importantly, are also practitioners, which means they will not only share their knowledge, but also actual experiences. The panel will be moderated by Mr Piotr Nowaczyk, an attorney, Chartered Arbitrator and a member of many institutions around the world, including the International Court of Arbitration in Paris. One of the experts will be Mr Mariusz Haładyj, Undersecretary of State in the Ministry of Economy.
The session will be held as a part of the V European Congress of SME on the 13th of October 2015 at 11.30 to 13.30 at the International Congress Center in Katowice. Participation in the Congress is free of charge.
